US v Jones, The 4th Amendment and GPS Tracking Devices — General Session

Allen L. Stidger, a retired Special Agent of the Federal Bureau of Investigation (FBI), is an attorney advocate for the rights of consumers and crime victims with a law practice focused on violations of the Texas Debt Collection Act (DCA) and Deceptive Trade Practices Act (DTPA). Allen is a 1975 graduate of Texas Tech and a 1984 of Texas Tech School of Law. In addition to being a licensed Texas Investigator and Attorney, he is a member of the College of the State Bar of Texas. Allen is President of ALSI, Inc., dba ALS Investigations, a licensed Texas Investigations Company and Owner of Stidger Law Firm, PLLC, both located in Fort Worth, Texas.

In January of 2012, the United States Supreme Court issued a landmark opinion when it decided a case titled U.S. V. Jones, which dealt directly with the implications of utilizing GPS Tracking devices. While this case has serious implications for those who utilize GPS Tracking devices, it also potentially impacts many other investigative techniques to include trash covers and cell phone tracking. This presentation will address and distinguish how the strictures of the 4th Amendment of the U.S. Constitution, does, and does not, apply to the activities of private citizens, and in particular, to the investigative techniques utilized by licensed Private Investigators.
